BJP’s Legal Stand Against AAP : The Battle of Allegations

Recently, Bharatiya Janata Party (BJP) leader Praveen Shankar Kapoor has started a legal process against Delhi Chief Minister Arvind Kejriwal and Cabinet Minister Atishi Marlena for alleged poaching. Aam Aadmi Party (AAP) leaders claimed that BJP offered money to lure AAP members, which forms the basis of this case.

Allegations and Legal Action

The defamation case originates from AAP leaders’ claim that BJP attempted to bribe AAP members into defecting by giving them huge amounts of cash. Kapoor asserts that these accusations are baseless and unsubstantiated. Despite their seriousness, AAP leaders have not been able to back up their allegations with any evidence.

From Accusations to Legal Notice

On January 27, Kejriwal tweeted that seven AAP MLAs were approached by the BJP with Rs 25 crore each to switch sides, while Atishi made similar allegations during a press conference on April 2. Kapoor, who had earlier sent a legal notice to Atishi over her remarks, has demanded an apology as well as a withdrawal of the statement.

Court Proceedings

Chief Metropolitan Magistrate Tanya Bamniyal of Rouse Avenue Courts has listed the matter for pre-summoning evidence on May 4. He seeks an apology from both television and social media platforms in addition to retraction during the press conference conducted by the AAP leaders.

Kapoor mentions about his association with BJP which has caused him humiliation and blame after Atishi’s claims fallout. The legal notice sent to her states that such statements could have serious civil or criminal consequences if they are not withdrawn and apologized for accordingly.
